DECREE

ON AMENDMENTS TO THE GOVERNMENT'S DECREE NO. 49/2013/ND-CP DATED MAY 14, 2013 ON GUIDELINES FOR THE LABOR CODE IN TERMS OF WAGES

Pursuant to the Law on Government Organization dated June 19, 2015;

Pursuant to the Labor Code dated June 18, 2012;

At the request of the Minister of Labor, War Invalids and Social Affairs;

The Government promulgates a Decree on amendments to the Government's Decree No. 49/2013/ND-CP dated May 14, 2013 on guidelines for the Labor Code in terms of wages.

Article 1. Certain articles of the Government's Decree No. 49/2013/ND-CP dated May 14, 2013 on guidelines for the Labor Code in terms of wages shall be amended as follows:

1. Article 8 of Chapter III shall be amended as follows:

An enterprise shall establish labor productivity norms as the basis for giving product-based pay to employees, following the rules below:”

2. The following paragraph shall be added to the end of Point a Clause 2 Article 10 of Chapter IV as follows:

“An enterprise employing fewer than 10 workers is exempt from submitting its pay scale, payroll, and labor productivity norms to the labor authority of district where its business facilities are located.”

Article 2. Entry in force

1. This Decree comes into force as of November 1, 2018.

2. Ministers, Heads of ministerial-level agencies, Heads of Governmental agencies, the Presidents of People’s Committees of central-affiliated cities and provinces and enterprises shall implement this Decree./.0}
