PROVIDING GUIDELINES FOR SUBMITTING REPORTS OF ENTERPRISES PROVIDING CREDIT RATING SERVICES, MARKET MAKERS OF GOVERNMENT DEBT INSTRUMENT UNDER DECREE NO. 88/2014/ND-CP DATED SEPTEMBER 26, 2014 OF THE GOVERNMENT ON CREDIT RANKING SERVICES AND DECREE NO. 95/2018/ND-CP DATED JUNE 30, 2018 OF THE GOVERNMENT ON ISSUANCE, REGISTRATION, DEPOSITING, LISTING AND TRADING OF GOVERNMENT DEBT INSTRUMENT ON SECURITES MARKET

Pursuant to Decree No. 09/2019/ND-CP dated January 24, 2019 of the Government on reporting regime of national administrative agencies;

Pursuant to Decree 88/2014/ND-CP dated September 26, 2014 of Government on credit ranking services;

Pursuant to Decree No. 95/2018/ND-CP dated June 30, 2018 of the Government on issuance, registration, depositing, listing and trading of Government debt instrument on securities market;

Pursuant to Decree No. 87/2017/ND-CP dated July 26, 2017 of the Government on functions, tasks, powers, and organizational structure of the Ministry of Finance;

At request of Director General of Department of Banking and Financial Institutions;

Minister of Finance promulgates Circular providing guidelines for submitting reports of enterprises providing credit rating services, market makers of Government debt instrument under Decree No. 88/2014/ND-CP dated September 26, 2014 of the Government on credit ranking services and Decree No. 95/2018/ND-CP dated June 30, 2018 of the Government on issuance, registration, depositing, listing and trading of Government debt instrument on securities market.

This Circular provides guidelines for submitting reports of enterprises providing credit rating services according to Article 42 of Decree No. 88/2014/ND-CP dated September 26, 2014 of the Government on credit ranking services (hereinafter referred to as “Decree No. 88/2014/ND-CP”) and guidelines for submitting reports of market makers of Government debt instrument according to Point dd Clause 2 Article 27 of Decree No. 95/2018/ND-CP dated June 30, 2018 of the Government on issuance, registration, depositing, listing and trading of Government debt instrument on securities market (hereinafter referred to as “Decree No. 95/2018/ND-CP”).

Article 2. Regulated entities

1. Enterprises providing credit ranking services according to Decree No. 88/2014/ND-CP.

2. Market makers of Government debt instruments according to Decree No. 95/2018/ND-CP.

3. Agencies, organizations and individuals related to submitting reports of enterprises providing credit ranking services according to Decree No. 88/2014/ND-CP and of market makers of Government debt instruments according to Decree No. 95/2018/ND-CP.

Article 3. Methods of submitting reports of enterprises providing credit ranking services

Enterprises providing credit ranking services shall submit reports as specified under Article 42 of Decree No. 88/2014/ND-CP to Ministry of Finance by:

1. In person or via postal service; or

2. To the email: baocaoxhtn.tcnh@mof.gov.vn; or

Article 4. Methods of submitting reports of market makers of Government debt instruments

Market makers of Government debt instruments shall submit reports as specified under Point dd Clause 2 Article 27 of Decree No. 95/2018/ND-CP to Ministry of Finance by:

1. In person or via postal service; or

2. To the email: baocaontltt.tcnh@mof.gov.vn; or

3. Other methods as per the law.

Article 5. Entry into force

1. This Circular comes into force from October 19, 2020.

2. Difficulties that arise during the implementation of this Circular should be reported to the Ministry of Finance for consideration./.
